In Maine, both private and public pools have a rule in common: they need to be enclosed by a pool fence (which needs to be at least 4 feet high) which also has a gate or a door with the ability to be securely closed and locked when it’s not in use. According to state law, it is permissible to have a wall of your home or dwelling as part of the barrier around the pool, although you will also need to install a couple of extra things, either an alarm for the door leading to the pool or a cover for the pool. However, if you happen to have an above-ground pool that has walls that are 2 feet or over, there is no need to have a barrier or a fence around it.
