The pool needs to be within an enclosure that can be locked, and the enclosure needs to be at least 4 feet high so that children cannot access the pool when it’s not in use. However, if an enclosure isn’t erected, a private resident can also use a pool cover, an enclosure, or another protective device that is approved by the Philadelphia Building Code.
Remember that although these were the laws listed for the City of Philadelphia, city residents also need to comply with county and state laws. For example, the state of Pennsylvania may have another set of rules, but since building codes are enforced locally, it would be helpful to check with the city and make sure that you are also respecting state laws with regards to your residential pool.
Despite regulations on a city, county, and state-level doing the best they can to promote safety for its residents, sometimes the law doesn’t cover everything. For example, the City of Philadelphia suggests that either a fence is built around the private pool or a pool cover is used, yet they don’t specify which pool cover would be the best.
